Herein lies the problem with the government trying to artificially control water levels in an attempt to remove the onus of property protection from the individual owner. Unfortunately what’s done is done and those homeowners on the lake not affected by high water will be left paying (through special assessments) to protect the other owners who built too low or too close to the lake.
As Drain Commissioner I would certainly ensure that these pre-existing controls were maintained as promised, but also explore for better alternatives. I would also discourage new agreements and artificial controls to prevent future conflicts and unneeded tax levies.
Brian points out that the protection of property rights is often overlooked and should be considered along with the environmental conservation responsibilities of this job.
